  • The insurance company selects its own appraiser.
  • Both appraisers attempt to reach a fair market value for your totaled vehicle.
  • If they cannot agree, they jointly select a neutral umpire.
  • Any valuation agreed upon by two of the three (your appraiser, the insurer’s appraiser, or the umpire) becomes binding.
  • Each party pays for its own appraiser; umpire fees are shared.

California’s Strict Standards for Total Loss Valuations

California law requires insurance companies and appraisers to follow very specific rules when determining the value of a totaled vehicle. These rules protect consumers from inaccurate or artificially low valuations.

What Counts as a Comparable Vehicle in California

A valid comparable vehicle must:

  • Be of like kind and quality
  • Be from the same manufacturer
  • Be the same model year or newer
  • Match the same model type and body style
  • Have similar options and mileage
  • Be available for retail purchase by the general public
  • Be located in the local market area
  • Have been available within the last 90 days

Newer model years may only be used if there are not enough comparable vehicles from the same year.

Acceptable Valuation Methods

Appraisers may use:

  • Asking prices or actual sale prices of comparable vehicles
  • Two or more dealer quotations if no comparable vehicles were available in the local market within 90 days
  • Documented valuation methods when standard comparables are not available

Any differences between the comparable vehicle and the insured vehicle must be fairly adjusted and clearly explained.

No insurer shall persist in seeking information not reasonably required for or material to the resolution of a claim dispute. No insurer shall attempt to settle a claim by making a settlement offer that is unreasonably low. The Commissioner shall consider any admissible evidence offered in determining whether or not a settlement offer is unreasonably low.

Additional fees you may incur are $275.00 for our representation in Appraisal Clause negotiations, and half of an umpire’s fee if either are necessary. On average, approximately 10% of Appraisal Clause cases go to an umpire.
